1. Acceptance of Terms

These Terms of Service (the “Terms”) govern your access to and use of the BuildPress plugin and the usebuildpress.com website (together, the “Service”). BuildPress is an independent software product (referred to here as “BuildPress,” “we,” or “us”). Purchases of BuildPress are sold and processed by our payment provider, Lemon Squeezy, which acts as the merchant of record (see Section 6), so your purchase is also subject to Lemon Squeezy’s terms. By purchasing, downloading, installing, activating, or using BuildPress, you agree to be bound by these Terms. If you are accepting these Terms on behalf of a company or other organization, you represent that you have authority to bind that entity. If you do not agree, do not use the Service.

2. Description of Service

BuildPress is a paid WordPress plugin that enables AI-assisted website building through the Model Context Protocol (MCP). The plugin runs entirely on your own WordPress server. There is no free edition and no separate “Pro” edition; BuildPress is a single paid product, and every license tier includes the same features.

BuildPress does not provide AI processing. BuildPress is not in the data path for AI requests and operates no AI cloud or proxy on your behalf. To use the AI-assisted features, you must separately obtain and maintain your own active subscription to an MCP-compatible AI client or service (for example Claude, Cursor, or Windsurf). BuildPress provides the tools; your chosen AI service provides the intelligence. Your use of any such third-party AI service is governed by that provider’s own terms and pricing.

3. License Grant

Subject to your compliance with these Terms and to payment of the applicable fees, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to install and use the BuildPress plugin on the number of live WordPress sites permitted by the tier you purchased. The current tiers, the number of sites each one covers, and the available billing options are described on our pricing page; the limit that applies to you is the one shown for your tier at the time of your purchase.

All tiers include the same features. Tiers differ only by the number of sites on which you may activate the plugin and by the billing period you select (an annual subscription or a one-time lifetime purchase). You may move between sites within your licensed limit by deactivating a site and activating another.

License-gated download and activation. BuildPress is not distributed on wordpress.org and is not available as a free or public download. You download the plugin from your usebuildpress.com account, and each download and each site activation is validated against an active license. We may verify your license server-side at download, activation, and on a recurring basis during use. Your license key is personal to you; you are responsible for keeping it confidential.

4. License Restrictions

Except as expressly permitted by these Terms or by applicable law that cannot be contractually waived, you may not, and may not permit any third party to:

• sell, resell, rent, lease, lend, sublicense, distribute, publish, or otherwise make the plugin available to any third party, whether on its own or bundled into another product;
• share, publish, resell, or transfer your license key, or use a license on more sites than your tier permits;
• reverse engineer, decompile, or disassemble the plugin, or attempt to derive its source code, except to the limited extent this restriction is prohibited by applicable law;
• remove, obscure, or alter any copyright, trademark, or other proprietary notices;
• circumvent, disable, or interfere with license verification, activation limits, update checks, or other technical protections;
• use the Service in violation of applicable law or to infringe the rights of others.

5. Intellectual Property

BuildPress, including the plugin code, the BuildPress name and logo, and all related materials, is owned by us and our licensors and is protected by intellectual property laws. These Terms grant you a license to use the plugin, not a sale of the software, and we reserve all rights not expressly granted to you. The plugin’s underlying PHP source is licensed under the GNU General Public License to the extent required by WordPress; that licensing applies to the code itself and does not grant you any right to redistribute the BuildPress product, our other assets, your license key, or our hosted download and license services.

As between you and us, you retain all rights to the content you create using BuildPress on your own site.

6. Billing, Renewals & Auto-Renewal

Purchases of BuildPress are processed by our payment provider, Lemon Squeezy, which acts as the merchant of record for the transaction. This means that, for billing and tax purposes, your purchase is made from Lemon Squeezy as the reseller of our product, and Lemon Squeezy is responsible for calculating, collecting, and remitting any applicable sales tax, VAT, or GST. Prices are stated exclusive of taxes unless otherwise indicated; applicable taxes are added at checkout based on your location.

Annual subscriptions. If you choose annual billing, your license is a recurring subscription that automatically renews at the end of each term at the then-current renewal price, using your payment method on file, unless you cancel before the renewal date. A subscription includes updates and support for as long as it remains active. You can cancel auto-renewal at any time through the customer portal link in your purchase or renewal emails, or by contacting us.

One-time lifetime purchases. A lifetime purchase is a single, non-recurring payment for ongoing access to BuildPress, including updates and support, for as long as we continue to offer the product. It does not auto-renew.

7. Cancellation & Refunds

You may cancel an annual subscription at any time to stop future renewals. Cancellation takes effect at the end of your current paid term; your license remains active until then, and you are not charged again.

You can request a refund within 30 days of your original purchase. Refunds are granted where there is a valid reason — for example, the plugin not working as described — and are issued once your request is approved. Because Lemon Squeezy is the merchant of record, approved refunds are processed by Lemon Squeezy on our behalf and returned to your original payment method; it typically takes around 5–10 business days for the funds to reach you, depending on your payment provider. To request a refund, contact us using the details below or use the order link in your purchase confirmation. After a refund is issued, your license is deactivated and you must stop using the plugin and remove it from your sites.

8. Expiry & Deactivation

An annual license is valid while your subscription is active; a one-time lifetime license does not expire. If your subscription lapses or your license otherwise expires, BuildPress stops authorizing AI build commands. The next AI command is rejected and the session will not run, even if the plugin is still installed and your MCP client is connected. There is no free or reduced “fallback” mode; to continue using the AI build tools, you renew your license, which restores access.

Your content and data — including widgets, project memory, project history, and audit logs — live in your own WordPress database and are never deleted by BuildPress as a result of expiry or deactivation. Renewing resumes BuildPress right where you left off.

9. User Responsibilities

You are responsible for:

• Security of your WordPress installation and App Passwords
• Content created through BuildPress (by you or by AI)
• Compliance with applicable laws and regulations
• Backing up your site before major changes
• Reviewing AI-generated content before publishing
• Keeping your license key and account credentials confidential

10. Third-Party Services

BuildPress works alongside services that you provide and control, including your WordPress host and your own MCP-compatible AI client or subscription. We do not control those services, are not responsible for them, and make no warranty regarding them. Your use of any third-party service is governed by that provider’s terms, and any AI processing happens through your own provider rather than through BuildPress. Payment processing is provided by Lemon Squeezy as described in Section 6.

11. Data and Privacy

The BuildPress plugin processes your site content and data exclusively on your WordPress server. Our handling of the limited personal data we collect through usebuildpress.com (such as account, purchase, and contact information) is described in our Privacy Policy.

12. Disclaimer of Warranties

BuildPress is provided “as is” and “as available” without warranty of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the software will be error-free, uninterrupted, or compatible with all environments, themes, plugins, or hosting configurations. AI-generated content should be reviewed before publishing. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.

13. Limitation of Liability

To the maximum extent permitted by law, BuildPress shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the software, including data loss, site downtime, AI-generated content issues, or plugin conflicts. To the maximum extent permitted by law, our total aggregate liability arising out of or relating to the Service will not exceed the amount you paid us for the Service in the twelve months preceding the event giving rise to the claim. Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you.

14. Indemnification

You agree to indemnify and hold harmless BuildPress and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Service, the content you create with it, or your violation of these Terms or of applicable law.

15. Termination

You may stop using BuildPress at any time by deactivating and deleting the plugin; your content remains in WordPress. We may suspend or terminate your license if you materially breach these Terms, including the License Restrictions. On termination, the license granted to you ends and you must stop using and remove the plugin. Sections that by their nature should survive termination — including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification — survive.

16. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated prior to taking effect. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

17. Purchases & Governing Law

Your purchase of BuildPress is made through Lemon Squeezy as merchant of record and is also subject to Lemon Squeezy’s terms and policies, which govern the sale itself. As for these Terms, BuildPress is currently operated as an independent project rather than through a registered company, so this section is kept deliberately simple: these Terms are governed by the applicable laws of the place where the operator of BuildPress is based, and nothing here removes any mandatory consumer-protection rights you have under the laws of your own country of residence. If BuildPress later operates through a registered legal entity, this section will be updated to specify the governing law and venue.
